TERMS AND CONDITIONS Welcome to bumblebags website. The Terms and Conditions set out below govern the use of and the sale and purchase of products from this website. Your use of this website confers your agreement to these Terms and Conditions. This website is owned and operated by bumblebags. We can be contacted via email at info@bumblebags.co.uk or by telephone on 01380 831134 Our postal address is: bumblebags SALES CONTRACT The contract between bumblebags and the customer comes into affect when bumblebags accepts payment for a customer's order. The goods remain the property of bumblebags until the customer takes delivery of their goods. bumblebags is entitled to withdraw from contracts in the case of any obvious inaccuracies appearing on our website whether monetary or typographical. PRIVACY bumblebags only uses customers' names, addresses and payment details for the purpose of completing transactions. We pledge that any information that you provide to bumblebags will not be disclosed to any third parties, under any circumstances. PRICING The prices of the goods are those specified on the bumbebags website. The price is inclusive of VAT (at the standard DELIVERY We deliver to mainland We will generally dispatch orders within 2-3 days of receipt. Should you require your order urgently then please contact us and we will do all we can to fulfill your requirements. We use a combination of Royal Mail and courier delivery. Royal Mail is generally used for orders where the total weight is less than 1.5kg. All orders above this weight will be dispatched by courier. Our standard delivery is charged at £7.95 (it costs bumblebags more than this figure but we make up the difference). With this method of delivery we aim to deliver your packages within 3-4 working days. Should you require more immediate delivery you should contact us to enquire as to the availability of next working day delivery. This delivery service is charged at £9.95. Delivery is free where your order exceeds £150. Working days are Monday to Friday and exclude all local and national holidays. Saturday deliveries can be arranged for an additional charge. Please contact us if you require this service. Please ensure that you are available to take delivery of your items as our couriers generally require a signature on receipt of goods. You may wish to consider providing your work address as the delivery point. Should it really not be possible to be present for delivery, it is sometimes possible for the courier to leave your delivery without signature - in a 'safe' place. Should this be the case, please provide details in the comments box at check-out eg ''please leave in porch' Delivery occurs at the point when the items ordered have been left at the address specified by you. We cannot accept any claims if the items ordered are damaged beyond this point SAFETY All toys included within our party bags carry the CE mark. Other items, not classed as toys e.g. fossils, pyrite, jewellery, hair bobbles, stationary, do not carry this warning as they are not toys. The bags and, in general, their contents are unsuitable for children under the age of 36 months due to, but not limited to, small parts which may present a choking hazard, or sharp points which may cause injury, or the risk of suffocation from the bag itself. Therefore our party bags must not be given to children under 36 months. We do not accept liability for any injury, damage or loss which occurs due to the bag or its contents, getting into the hands of a child under 36 months. Furthermore cords/ribbons (such as those which secure the pirate flag bag) could be dangerous for children as they could become entangled. Cords are also strangulation hazards. Adults should therefore remove these immediately and dispose of appropriately. The contents of some bags, as set out in the 0-3 age range category of the website are suitable for children under 36 months. However, the bags themeselves, along with the packaging and labels are not suitable for children under 36 months and therefore adult supervision is required at all times until the bag and packaging have been removed and safely disposed of. Our bags are provided with a gift tag attached which includes safety warnings. It states that the bag and packaging are unsuitable for children under 36 months and, unless bought within the 0-3 age range category, that the contents are unsuitable for children under 36 months. Where the bag was bought from the 0-3 age range category, this label states that adult supervision is required at all times until the bag and packaging have been safely removed and disposed of. The customer must not remove, or allow anyone else to remove these labels. This also applies to any other labels or packaging that are attached to or placed within the party bags or any of the items therein, which provide warnings, safety information, instructions or any other information. We do not accept liability for any injury, damage, or loss that occurs due to any of the labels or other information, as stated above, having been removed. Additional age limits are provided for some bags. Where an age limit is provided it means the party bag in question contains one or more items recommended by the manufacturer as being unsuitable for children under this age. We cannot be held responsible for our party bags getting into the hands of a child below the specified age. It is the responsibility of the customer to ensure that our party bags are not given to anyone who may have an allergy or any other specific condition, which may make the party bag or its contents unsuitable or harmful to them. We do not accept liability for any injury, damage or loss that may occur due to our party bags having been given to anyone for whom they were unsuitable, as detailed above. SUBSTITUTION In the event that one of our items is out of stock we will substitute it for something that is appropriate and equally as desirable. Should the item not available form a large part of the party/gift bag, bumblebags will contact you as soon as possible in order to agree an acceptable alternative or to offer a refund. DAMAGED ITEMS If the delivered product is damaged in any way, bumblebags will either replace the damaged good or offer a refund on the purchase price of that item. bumblebags must be notified of any damage/shortfalls within 24 hours of delivery acceptance. Should we not be notified of any damage within this 24 hour period it will be deemed that your order has been delivered to you in a good and satisfactory state and no future claim relating to damaged items can be made. REFUNDS OR EXCHANGES If, in the unlikely event you are not entirely happy with your purchase, bumblebags will provide a full refund or exchange. Simply contact us within 48 hours and then return the items to us. Upon receipt, we will provide you with a full refund or exchange (less original delivery costs). Return postage costs are to be paid by the customer. The party/gift bags must reach us in both their original packaging and condition in order for a refund or exchange to be provided. Returned goods must be received within 7 days of their original receipt by the customer. We cannot accept responsibility for any loss or damage which occurs to items whilst in transit to us, or which occurs due to any other circumstances beyond our control. Registered post or recorded delivery is advised when returning goods and that proof of purchase is retained. INTELLECTUAL PROPERTY All of the website design, information, data, text, graphics, logos are the property of bumblebags. Unauthorised use of the material or republication without the prior written consent of bumblebags is prohibited. GOVERNING LAW These terms and conditions and any contract arising between the customer and bumblebags are governed by English Law. VALIDITY If any part or parts of these terms and conditions are deemed invalid, void or unenforceable, they will be considered severable from these terms and conditions. However, this will not prevent the remainder of these terms and conditions from being enforceable or effective. REFUSAL We reserve the right to refuse any order or transaction, for whatever reason and without giving notice, whether or not monies have been paid DISCOUNTS AND PRICING We retain the right to change our pricing and any discounts offered, at any time and without giving notice. GENERAL LIABILITY We are not liable for any loss of profit, loss of business or any other consequential, special or indirect losses, costs, expenses or other claims for compensation, whether caused by our negligence or not, in connection to the products offered for sale on this website or their use or the manner in which we have delivered our services. We are not liable to pay you any compensation other than a refund equal to the price of the products that you have paid for. DISCLAIMER bumblebags and our respective suppliers make no representations or warranties about the accuracy, completeness or suitability of any visual material relating to products detailed on this website.
